SMS Consent & Messaging Policy

This SMS Consent & Messaging Policy (the "Policy") is published at https://theguys.app/sms-policy and is incorporated by reference into the TheGuys.app Terms of Service.

1. Who We Are

TheGuys.app is a software platform operated by TheGuys App LLC, a Wyoming limited liability company with principal place of business at 1883 West Royal Hunte Drive, Suite 200A, Cedar City, Utah 84720 ("TheGuys App," "we," "us," or "our"). When you use TheGuys.app, the platform sends and routes text messages to and on behalf of the people who use it.

2. What Messages We Send

If you create an Account on TheGuys.app and consent to SMS, you will receive automated text messages from TheGuys App and from other Users acting through the Platform, sent to the mobile number you provide. The categories of messages we send are limited to:

Job dispatch notifications — when another User has selected you to perform a Job.
Job-related updates — confirmations, cancellations, schedule changes, check-in reminders.
Account notifications — security alerts, login confirmations, password resets.
Platform-operational messages — billing notifications, payment confirmations, payout confirmations.

All messages sent under this Policy are transactional and operational. We do not send marketing or promotional SMS under this consent.

3. Why SMS Consent Is Required at Signup

TheGuys.app is a dispatch platform. The core function of the Platform happens by SMS. For this reason, SMS consent is required when you create your Account.

Once your Account exists, you may revoke SMS consent at any time using the methods described in Section 6.

4. Message Frequency

Message frequency varies with your activity on the Platform. We do not commit to a specific message-frequency limit.

5. Message and Data Rates

Standard message and data rates from your mobile carrier may apply. We do not charge you for SMS, but your carrier may.

6. How to Opt Out

You may revoke your SMS consent at any time using any of these methods:

Reply STOP to any Platform SMS.
Open your Account settings and turn off SMS Notifications.
Contact us using the contact details in Section 12.

When you opt out, your Account remains active.

7. How to Get Help

Reply HELP to any Platform SMS for assistance, or email support@theguys.app.

8. Phone Number Accuracy

You are responsible for keeping your mobile phone number current on your Account.

9. When You Invite a New User to the Platform

We will not send any SMS to a new person until that person has registered an Account and affirmatively consented to SMS through the Platform's signup flow.

When you provide a phone number for another person, you represent that the person provided the number to you and that you have a legitimate work-related reason to enter it.

10. Carrier Compliance

TheGuys.app sends SMS through a registered application-to-person (A2P) sender. Mobile carriers are not liable for delayed or undelivered messages.

11. No Sharing of Mobile Information

No mobile information, including phone numbers and SMS opt-in or consent data, will be shared with or sold to third parties or affiliates for marketing or promotional purposes.
